Evening
I am hoping someone can point me in the right direction with this one.
The back garden wall of our recently purchased home is leaning forward and needs rebuilding. The land directly behind the wall is I think, council waste ground. A friend has had a look at the wall and reckons its the trees and earth behind the wall that is pushing our wall.
He has suggested contacting the council as if it is their land that is causing the problem they should pay at least half the cost.
Does anyone know how I can find out who owns the land and also which dept of the council to harrass for money lol??

If it's a green space, then it's probably parks and gardens.

I'm going to be cross if it is a green space and you're calling it waste ground though.

That's why people think it's okay to dump rubbish on it :mad:

If there is nothing on your Title documents or Deeds to the contrary then if the wall supports their land then they are generally responsible for it - and vice-versa.

If something on their land is causing problems with your property then they are responsible under various items of property case law. If it is merely a boundary then it is usually 50/50 - if you can get them to pay up!

Speak to SCC Property Services at Carbrook Hall Road. Nobody else at the Council is responsible or can give you a credible response. Prop' Services are usually pretty good after a bit of shilly shallying about responsibility - like any commercial company.

You may need a specialist property solicitor if they don't respond favourably, but I think you should get there on your own.

hi, you need to look at the Boundary Wall Act, not sure which year it is but it covers issues like these (do a search on the internet to found out the year). To find out who owes the land contact the Land Registry, they may charge you about £3 to investigate, and they should be able to tell you who owns it if the land is registered, I think after about 1980 all land is registered....

don't worry Strix its not a park its a bit of hill thing between our back wall and the road, thanks for the advice guys :-)
