View Full Version : Dog problems next door: how do I stand?
Sam Miguel 05-03-2005, 19:20 The family next door to me have three large dogs.The only time they see natural light is when they are let out in the morning and evening onto their back yard to go to the toilet. We live in the middle of a terraced block and have to cross their yard to get to our house.
The mess doesn't always get cleaned up straight away and can be there for hours before it is attended to.
I have had several words with them about this in the past and have told them I will get in touch with Environmental Health if the problem persists, which it has.
We have trodden the foul substance into our own house on several occasions, and visitors always comment about it when they come to our house. It's embarrasing to say the least.
Advice, please.
I dont think there is anything you can do to be honest, any complaining to the neighbours wont work, you'll just look like 'the moaning neighbour' next door and will probably get your neighbours backs up.
I think you're just going to have to ignore it I'm affraid.

Take a shovel and drop as much as you can scoop on it straight outside their door, so they tread in it. That worked for me with my neighbours.:thumbsup:

But wont the neighbours know its him?
And I think a few fists would be flying if someone did that to me and I knew who it was.

It is one of these sad stories which sounds like a no-win situation. You will still have to live next door to each other but things could get worse after official intervention is sought.
Is there a neighbour on the other side? Are you the only one that needs access through the yard? Are you alone in your problem?
Organise a BBQ in the yard with lots of like minded friends, neighbours and invite the dog owners (and their parents?)
If the mess is there, guests will collectively comment on it and have some effect. If he cleans it up in advance then thank him for that and get others to tell him what a good difference it has made.
If it has no effect, buy an elephant!

matsalleh 05-03-2005, 21:34 I live in a mid terrace and the backdoor goes through one neighbours to an alleyway.On my deeds it is marked as a right of way,whether dog mess is classed as obstructing your right of way I don't know.But a quick word with a solicitor would soon find out.

I wouldn't have thought a dog poo could be classed as an obstruction; guess it depends how big the dog is! :hihi:
Seriously though, if a dog poo could be classed as an obstruction, it would apply to anything of a similar size (or bigger) you could find around there; dustbin, milk bottle, patio chair all spring to mind!

If it's cleaned up in a time frame quoted in hours rather than days, multiplied by three dogs, I doubt it looks like Mt. Everest!
Either way, we need to help Sam find a solution; I don't think we're there with that just yet!

Sam Miguel 06-03-2005, 10:17 Thanks for all the replies. But what about the health issue? Surely this can't be right? Surely they have an obligation to keep things clean if it is endangering the health of others.
I'm sure that treading the horrible stuff into our own house could oput our health in danger.
Also, I have a terrible aversion to dog ****. I literally feel sick and can't eat for about half-an-hour after seeing or smelling the stuff.
Please tell me I can report them.
Try contacting your local councillor about it and ask them to look into it. This type of behaviour could be covered with an ASBO. Which ward do you live in?
muddycoffee 06-03-2005, 10:49 I sympathise with you, but I would say that it would bother me a whole lot worse if the dogs barked all night.
On the whole I would revert to a strict no shoes in the house rule, and make sure everyone takes them off in the doorway.
I consider it abjectly cruel to have a dog, especially a large one and not take it for a good hour walk every day.
Have you thought of asking the RSPCA?
They might remove the dogs if an inspector feels that they're being neglected.

If it is public access (but I doubt it) then the council can issue fixed penalties (via the Dog Wardens and Fouling Byelaws)
If it is 'housing' property the same applies.
If it is private property (albeit with shared rights), then it becomes a matter for Environmental Enforcement/Health and will be a long drawn out process of keeping logs (no pun intended), taking photos and getting officers to visit at the right time.
Once they are satisfied there is a problem they will try for informal resolution by talking to him and failing that can take out enforcement orders against him.
Environmental Services (including Dog Wardens) are on 203 7410. If they say it is not their problem, badger them to give you a name of who is responsible in Environmental Enforcement.

Would you really assault a neighbour who complained about something like this? Especially as you would be blatantly in the wrong in the first place ...
Dogpoo shouldn't be left more than a minute let alone hours ... it's disgusting and a health hazard as well as a nuisance ... I agree about it making you feel sick too.
I used to have several dogs of varying breeds and sizes, and although we have a largish private garden - the next door neighbours complained about the smell ... even though I always used to clear up after them straight away, as I don't care too much for it myself either. I was mortified and embarrassed and apologised profusely... it never occured to me that a glasgow kiss or a smack in the mouth might have been an appropriate response :) ! Although the stink of them cooking bits of dead animal outside in the summer used to make me heave too ... but that's another story ...
(goes into Meldrew mode) mutter, grumble...no wonder society is in the state it's in today if this is the response you can expect to a reasonable request ....mutter. mutter)
roughy101 06-03-2005, 13:47 put some jeys fluid down, dilute it in water it wont hurt the dogs as it is pet safe,but they will not want to do it if they cant pick up the scent,bit of luck they may start doing it indoors.
happychick 06-03-2005, 13:51 Had a similar problem with my neighbours,only difference being that their 3 dogs used their back garden for a tiolet. My neighbour NEVER made any attempt to clean any of it up though.It was just one long layer of dog c**p.Asked them to do something about it many times,result,nothing.
It was the health issue that bothered me,cause when it got warm we got bombarded with flies and boy did it stink.I couldn,t have my back door open in the summer,it was really nasty urgh,horrible.
Anyway in the end i thought sod this,phoned envirnmental health at Sheffield Council,the came within 3 days.They were made to clear it up, and clean it up as well.It has been left on file,and if it gets like it again they will be taken to Court.I was shocked, I hadn,t realised the Council would go that far.But it is a health issue, and they do take this kind of thing seriously, so go for it.

If this is always the case then I am afraid that the nuisance/health element becomes harder to prove.
If it is Council property/public access then the current law makes it much simpler and purely the connection of a single turd to the dog/owner can warrant a fixed penalty.

You will as far as i understand, need to follow the offending owner/ dog around with a camera to get evidence, or technically, who is to say which dog did it. This is not twaddle (surprisingly) as it happened to one of my friends ages ago, and the dog wardens told him this.
bostonaire 06-03-2005, 14:34 my view on it is .and im not in the know........but if its public access.then going along the lines of where council make dog owners pick up and dispose the dog mess in those dog mess bin things then surely if thats the done thing out in a park and some fields.then surely you can put your case across to someone with the enviro lot,after all if kids are around isnt it dangerous?:confused:

They will be warned of my intentions before I act.
Also, the neighbour from the other side is with me on this, even though he doesn't have to cross their yard to get to his house, he finds the sight and smell of it deeply offensive.

I am the owner of the 3 large dogs that are mentioned. I spoke to Sam Miguel last night and cleared the air with him, and would like to reply here in writing as well. I just want to clarify that as I work shifts it will not always look like the dogs are being walked everyday, since they do not get walked at the same time every day. Sometimes its late at night, early morning, middle of the day, but I assure you that they receive 2 long walks a day. They are also let out of the house various times during the day to play in the back garden. Dog muck in the yard is cleaned asap and is jetwashed regularly. We have 2 young children in the home and obviously do not want a health hazard outside our house. We got 2 of our dogs from the RSPCA on seperate occasions who did the relevant home checks. As, I stated, the air with our neighbours has now been cleared and I hope we can make peace and get along in the future. Thank you.

It's nice to hear for a change a neighbour taking on board his fellow neighbours concerns and trying to sort it out amicably.
Only too often you hear of such disputes getting out of hand and ending up in violence. I can sympathise with both parties involved. We have a dog who dumps on our own garden and I hate it so I would hate it even more if it wasn't my dog!!
The worst thing is now when the weather starts to turn warm (hopefully) cos then our garden really stinks as it just heats it up causing a lovely aroma of cooking poo :gag:
Since our dog is my partners and I also have a severe reaction to dog poo I have to wait for him to clean it up. Don't know why but I have no problems with cleaning 4 kids pooey nappies but no way can I deal with Dog Poo.
Hope you can both sort things out.

It's good to hear that you take your dog ownership seriously. And brave of you to come on here and confess ownership. I don't know about what arrangements that you have come to with sam, and I hope you can get along as neighbours.
Please be ultra aware of what offence, your dogs have caused in the past, and what frustration has been shared between people on this thread.

It's actually as easy to train a dog to stick to one area of the garden as it is to house train him/her. Brude only raises a leg on the plants when I tell him (to upset the cat who has made a regular 'habit' in one spot). He has a shower tray to use in the garden, coz we found the smell of dried urine difficult to stomach too ;)
I know of a couple who have a gents urinal behind some conifers in their garden for thier herd of irish wolfhounds to use :thumbsup:
Unfortuantely our dog is 12 and as they say you can't teach an old dog new tricks!!
I have only known her for five years as she is my partners dog he let her get away with all sorts - sleeping on the bed, laying on furniture, although she knows not to do that now getting her to dump in one spot only, I have not managed to do.
the council can't intervene if it's crxxxxxg on private property, you have access to come & go only usually on conjoined properties, you have no rights to the footpath.
H&S is the only issue that coiuld be enforced butyou would have to keep records & frankly the problem isn't big enough for the council to act.
(from a 3 dog owner in a terraced property where the neighbour keeps complaining - joking)
You could try a totally different approach.
If the Environmental Health people won't / can't do anything, how about the RSPCA?
You say the dogs only see natural light first thing, then the owners may be forced to take them out for a c**p.
Just a thought.
