View Full Version : Advice on ending tenancy agreement
hi my tenancy runs out on the 17th march i ve been told i dont have to give notice moving to council house which is ready now really worried about telling landlord as hes expecting me to stay for another year and he wanted 3 months notice but also been told this is nt right does anyone no thanks
You said your tenancy runs out of March 17 - I'm assuming this is the end of a fixed period of six months, a year or longer. If so this is the END of the tenancy and you are not obliged to give 3 mnts notice as the tenancy was until this date, so don't worry you are free to move out. Be careful though if you have agreed verbally or in writing to an extension beyond this date as this could give your landlord grounds for holding you to this and you may want to get some further advice on this (try citizens advice). Don't be intimidated though. good luck.
I think you owe it to your landlord to tell him as soon as possible that you will be moving out. Don't leave him without a tenant just because you are nervous at giving him a call.

cgksheff 27-02-2005, 16:52 No straightforward answer to this other than "Read your tenancy agreement" (assuming that you have one) and see what it has to say on the subject.
Even though it sounds like a shorthold tenancy it is possible that a clause may be there that says something like 'in the event of no notice being given, this lease shall be considered renewed for a further ..."
hi theres nothing in the tenancy about this ive spoken to him today he s going to consult his solicitor tomorrow been told i can just move out on due date which he says is 16th he also asked if i could move earlier but told him he cant kick us out before as he as to give me two months notice i have two small children also so i ll see what he says tomorrow i ll let you no thanks
999tigger 27-02-2005, 20:41 Unlikley he will consult a soliictor as it will cost him. Surely a practical approach is best. The tenancy will expire on the due date and you leave then. Not one day later as a periodic tenancy will come into creation.
hi he said he was gona ring one in morning and let me no how do i no that he s telling truth though all i no is contacted shelter twice and cabs as well both say same i can move out when contract ends
WallBuilder 27-02-2005, 21:44 Hi Den,
If it is a standard tenancy agreement with no odd clauses in it your landlord can contact who he likes you're not doing anything wrong. Have you just spoken to CAB on the phone or have you been in too see them? I'm sure if you showed them the tenancy agreement they would of noticed anything out of the ordinary. It sounds as though your land lord is just trying it on and doesn't want the property stood empty whilst he looks for another tenant. If you paid a bond just double check with CAB on any reasons he could have for retaining this as an unscrupulous land lord might try this tack.
hi taken agreement into cab they could nt find anything at all just got to wait till he rings in morning but how will i no he s spoken to someone or lying i no my rights though so have to see thanks for replying
hi thanks for everyone who replyed here spoke to landlord and can move out on 15th though he wants carpets cleaning he wont do it and take it out of my bond anyway just glad it got sorted at last can plan things now and book removals thanks and bye

WallBuilder 28-02-2005, 23:03 Now,now punk,.... If I remember correctly den37 has got two young children so drawing breath is a luxury for her I bet.
Den are you going to clean the carpets yourself or get some one in to do it for you? If you need a recommendation for a good carpet cleaning service let me know as somewhere amongst my paperwork I've got the card for a guy who did mine and he was very good.
Let us know how you go on and I'm dying to hear about your first fire lighting experience.
hi yes if you could find the carpet cleaners number that would be good they ve converted the council house to gas which i was pleased about so no lighting fires lol bye
WallBuilder 01-03-2005, 17:57 Hi Den,
I've sent you a pm but thought I'd just give out the guys number in case some-one else is thinking of having their carpets cleaned. If Max comes in muddy and rolls around much more I might be calling on his services again in the near future.
