hi my tenancy runs out on 17 th march been offered council house landlord told me he needs 3 months notice been told this is nt right and can just walk out on 16th if property is ready and get bond money back or might have to give two months notice does anyone no going to citizens advice tom thanks

Hi den I'm no expert but if your tenancy agreement is due to run out then that would appear to be the end of your tenancy. Why would you have to give notice? it doesn't make sense unless you've signed a very bizarre short term tenancy agreement.
What's wrong with CAB I've always found them very helpful

Your tenancy agreement although expiring on 17th probably includes a notice period. This should be no longer than 1 month. But without reading the actual agreement I would not be able to be specific. It is the landlord who has to give a minimum of 2 months notice. When your 6 month tenancy expires it automatically becomes and periodic tenancy until such time as notice is given. This provides security for tenants where landlords do not give follow up tenancies. The same rights exist as in the original tenancy but you are not tied to a 6 month period just a monthly one which needs to be terminated on a period end i.e. 17th of any month giving a months notice if this is what is in the original tenancy agreement.

If you signed a tenancy agreement specifying a 3 months notice on your side you may need to get legal advice about your actual position.

hi thanks for replys been to cab today i can walk out on 16th cant do anything about that its just if it goes to 17th have to have verbal agreement between us but should be a month moving to council house but might not get keys to look at it till 17

If you've got a short term tenancy agreement and it runs out on the 17 th then you should be moving out at that time. However if you don't you're not going to be thrown out on to the streets. Although you don't have any legal right to be in the house it can be very difficult to get a tennant out without involving the court, all this takes time, hopefully it wont come to this as you'll be able to move to your new place.
Where is the council property? If you can't get the keys to look in it then can you peer in the windows, the council wont of put it back up for rent if it needs work doing on it. Also have a chat to the neighbours they'll probably be able to tell you lots about the place.

hi can move out up to 16th and dont have to give notice but the rent was from 17th so been told if it goes to 17th it would have to be a verbel agreement between me and landlord as that when contract should start looked through windows of house and seems ok but might not get keys till 17th march anyway thanks for your reply
