View Full Version : Housing in sheffield for homeless
I recently went away for a few month to come home and discover my landlord had sold his house. I have a 1 yr old child and am 32 weeks preg with second. I've heard that the council has a homeless section but I am weary of going there as in 2001 i was evicted for non-payment( I lived with a drug addict crappy boyfriend). The house was in joint names. I can't afford to pay the arrears back yet so what else can I do??????????
I am currently staying with mum but can't bring up two children in one small bedroom.
Go to the housing and explain your situation, they will sort out a way for you to pay your arreas off at a rate you should be able to manage, it should be around £3 a week.
You have special circumstances and a priority so they should rehome you, unfortunately you won't have much of a choice where, you can pick the areas to bid for but you have to accept the first place that's offered.
SupraSteve 10-12-2007, 11:32 If you had a tenancy agreement with a notce period then it is my understanding that this is still enforcable. Either the new owner takes you on as an ongoing tenant, or you get to carry on living there (and paying rent) until the notice period expires. Ask at the CAB for info, I'm sure they'll be clued up on this - take along a copy of your tenancy agreement if possible.

I think you will find that if she went away for 2 months, this would be deemed an abandonment unless prior written warning was agreed and rent was paid, if this was the case, the landlord could be subject to an illegal eviction and the 1 month notice would have applied, depending on tenancy agreement.
Go down to Howden House and say you are homeless, explain the sitiation, as mentioned above, your arrears may affect your chances, but they will more than likely put you on a repayment plan of no more than £3 a week. You will also be given a priority and hopefully a place for Xmas!

Ah yes, I suppose it depends a lot on whether the rent was paid or not - I'd assumed it was. Surely I am free to go on holiday for 2 months though, and if I've continued to pay the rent on time, can come back to my home and expect it to still be mine? (That's if I had the money to go on hoiliday for 2 months! I wish, lol ;))

No, you're not.
The landlord is (usually, and once the initial minimum term has expired) only required to give a month's notice, and it's not his fault if you aren't opening your post because you're in Africa. :)

Sorry, I should have said - assuming that the landlord hasn't issued notice; I hadn't take that potential scenario into account.
michdia - is this the case?
Normally you have in a tenancy, a clause called absence from premises and usually it is an agreed timescale - 7/14 days, unless prior written consent is agreed by the landlord. If you are paying rent and you have agreed that you are going on holiday for 2 months, then technically you are still in posession of that property and thus the landlord cannot just sell up.
yes i had a agreement with landlord over length of holiday. Not interested in landlord situation thats sorted, just housing problem i'm interested in!!!!!!!!!!!!!
Go down to Howden House, there is your answer!!!:hihi:

I would say that the two (LL situation, and the housing problem) are interlinked, wouldn't you?

To some extent yes, but what she needs at this point isn't advice on how to force her LL to let her back in, but advice on how to find somewhere else to live.
That's not to say the landlord issue isn't worth discussing, though.

Surely that depends on whether she and her possessions have actually been removed from the property or if she's got access to the home and has just been told that 'the house is sold and you'll probably have to move out, sorry about that'.

According to Michdia - the landlord issue is sorted!!!! So if she is happy, then there is no point discussing it.
The quickist way to get a property would be via Howden House Homeless, other options are local housing associations like SYHA, Northern Counties, Arches etc, but this will take more time and untimately if she has arrears that she is not paying off, they wont rehouse her, but it may be worth exploring further.
Ms Macbeth 10-12-2007, 17:00 Good advice on the thread about going to Howden House and explaining your situation. I would also suggest getting some advice and support from Shelter - they have a free helpline and will be able to advise you on your rights.
