Hi

I would be really grateful if anyone could advise me and give me some information with a possible swap that I may have.

I currently live in a 2 bed Council house and the person I may swap properties with has a 3 bed Housing Association house, now what I want to know is does this effect my right to buy and the discount I have built up over the years of being a council tenant, would I loose this if I take on a tenancy with a housing association owned property?

Would they be able to say no to the swap considering it would just be me, my partner and my son moving into a 3 bed house cos I really hope not, I would be gutted if the kabosh was put on the move so early on as I have been trying to move to Sheffield for over a year now.

Any info you have would be greatly recieved.

What you are proposing to do is known as a Mutual Exchange. This means that you exchange completely the tenancies that you have.

You do not terminate your tenancy and start another one. The two tenancies are dealt with by 'Asignment' . This does affect your right to buy. As you take on the Housing Association tenancy and you may not have any rights to buy. Right to buy with an Association is known as a 'Right to Acquire' but it only applies to certain properties and you will have to check whether the property you are wanting to mutually exchange with is eligible or not. The tenant taking your property will get your right to buy.

You need to check this by contacting both the Council and getting them to explain it fully for you. And to contact the Housing Association who will be very helpful and give you all the information you should need. You will need to ask very general information as they will not be able to discuss the actual tenants circumstances in any way.

You will need also to check with the other members of the swap that there are no rent arrears as these will be swapped too.

Normally a Housing Association will not refuse a Mutual Exchange without very good reasons as they have to justify any such refusals.

There are timescales that both the Housing Association and Council have to abide by in dealing with mutual exchanges and they will be able to give you all this when you talk to them
