Ok,

I didn't think this was allowed but apparently, I have the right to clamp cars that park on the road, over my drive (if there's a sign up of course).

I thought it was only on your property you were allowed to do that but when complaining to someone about people parking on the road over our drive (which we put in for my dad, who runs his business from here but doesn't live here and myself, as I am disabled and sometimes need access via the drive).

Is there anything I can do? At the moment we haven't got a drop curb, but are waiting for one to be put in.

Private property only, and then only with the appropriate signage.

Herein lies the problem... without a drop kerb you do not have permission from the council to drive onto your own driveway.

You yourself are actually breaking the law to park on the driveway, technically you do not have a driveway, you've only got a lump of concrete / tarmac instead of a garden. It is therefore quite legitimate for anyone to park in front of this bit of concrete.

When you get your kerb lowered the situation changes, then you can complain.

Thing is though, as a 19 year old being told by older, more experienced people that you can complain/clamp - you have to double check these things!

I only know cause I had the council shouting at me years ago, I had a lorry on my drive without a dropped kerb, they woz not happy.

Hi Lotti

Regarding your parking problem. Whilst the volunteer admin has correctly informed you that you cannot clamp people obstructing your drive you are not entirely without options.

You, or in fact anybody else, dont have an automatic right to park outside your house. However, if someone parks in such a way as to obstruct access to your drive that is a different matter. This can include parking over your drive or parking so close that you physically cannot manouver your car in. In this case you can complain to the police who will (time allowing) speak to the owner and perhaps help you in that way.

Also if you speak to the Council a small number of disabled drivers have been granted permission to have a disabled parking bay painted on the road in front of their property.

If you ask for it make an issue of the 'Disability discrimination act', might get it done quicker

Thanks guys,

The car shouldn't keep being parked there anyway as it has no permit, and the area it's parking in is permit only.

I've called parking services who have sent two wardens up and they've completely ignored the half a dozen cars parked up the road with no permits :rolleyes:

Can I still complain if we have no dropped curb? Or do I have to wait until it's been altered?

As far as I remember from my days of dealing with such things you cannot claim anyone is obstructing access until you have a definite method of access such as a path or dropped kerb.

I have a question on this,does the car that the yellow disabled box apply to have to show a blue disabled badge ? Apart from the yellow box should there be any other markings nearby (lampost etc.?)
Could any other disabled driver use that bay if available ?
I am asking this because I parked in just about the only available space on that street one morning here (http://picasaweb.google.com/bigdave92/Misc/photo#5128923073431672930)

The next morning I found a note on my windscreen threatening police action as I was in the disabled bay.As the guy knows me and there was plenty of room for the disabled car I thought he was a bit over the top,technically right I suppose but given the difficulty of parking in that street and others in the area I thought it was a bit excessive,I would have ignored him but :-

This a statement of the facts not any jumping to conclusions on my part.The guy has gone away for the weekend so I have not been able to confront him.

If you have a disabled spot painted outside your house then anyone with a blue badge can park there- it's not a personal parking place. All they have to do is to display their blue badge in the spot. Even the person who paid for the spot in the first place is expected to display their blue badge when parking in it.

Two important factors when considering getting a disabled parking spot painted on the road are:

1) you pay the cost, which is currently a little over £100, and
2) there is at least a year's waiting time for getting them painted.

I enquired about getting one painted, sent in the letter and payment and had the approval, but by the time they got around to actually doing it I no longer had a car so I had to cancel the work. 9 months later I got another car and now I have to go through the whole year of waiting again if I want to reapply.

If a disabled bay is painted onto a road, how long is that parking space valid for? Is it removed once the person who requested it is no longer entitled to, it or does it stay permanently?

If it's painted as a 'private' space (even though they're not the only ones who can use it- see my post earlier) then the amount you pay to have it painted also pays for it to be removed if you no longer need it or even for it to be moved if you move house (burned off and painted somewhere else instead).

In theory only the ones which are still needed by current occupiers should still remain, although obviously there is the council backlog in actioning their removal when they no longer relate to someone in local housing.
