i have a chip shop and park my car outside it it hasnt been a problem ,until some new people have moved in across the road,now ive been told by them to move my car so they can park there,as they have a skip outside their house,the son has no manners at all,would the police be able to help?,whats your veiws please,my car is legal and he said he will move it himself.

I would assume that as long as your car is taxed, then you can park where you like, legally of course.

Just because they are having a skip outside their house, it doesn't mean they can then dictate where they park their car. Nobody asked them to get a skip so really its a case of who gets there first.

Make sure you have a video camera handy in case the son does try owt - criminal damage is always easier to prove when its on film!!!

I'd mention it to the police just in case something does happen to your car, ask them though to keep it low profile as if they know you've been talking to the police it might be like a red rag to a bull.

yes i would inform the police they log evry call and you can just quote the incident number if there are any problems as for parking your car out side so long as its taxed and tested i can see no probs so long as there are no parking restrictions in the area best of luck anyway steve...:thumbsup:

I thought it was the skip that was illegally parked :confused:

I know they're usually tolerated, but I don't think anybody has a right to obstruct the highway with one. I'm not sure though.

i think so long as the skip has markings on it there is nowt to stop them putting there and it must have a flashing light during the night time by-laws permitting of course :thumbsup:

As far as I know there's no way under the law that they can force you to move your car. There is a precedent that you have some right to park a car outside your own home and can insist that others move their vehicles to allow you to park.

But if these people stick a skip in front of their house it seems to me that they've used that right with the skip and surely they can't just demand preference from others for their car?

You mentioned the fact that a member of the family has told you he will "move" your car...how will he do that? Sounds like criminal damage or TWOC might be involved.

Call the police on the quiet and make a dated record of all that transpires and photograph any damage done.

And get a baby monitor! You should be able to hear any 'interference' with your car if you leave the baby unit inside. Double glazing is so effective at preventing you hearing what's going on outside!

do you live in an LPT area? where you have local bobby type people patrolling? you can always ring the 202020 number and get it logged and recorded, just in case.
someone mentioned cameras - which is great idea. they cant tell u where to park car - they are PUBLIC roads remember and you are the public

The skip hire company needs a license from the council to leave a skip on the highway.

You have no rights to claim parking space outside your house on an unrestricted road. You have rights to have action taken with regard to obstruction of an access.

Be sure that you have carefully thought out how far you want things to go before you talk to the police.
I would sadly suggest that if they are the type of people that would carry out such "threats" then it is likely that your problems could escalate rapidly if the boys in blue make contact with them over this.
Depending on how you handle your initial police contact it can sometimes be taken out of your control and they are spoken to whether you like it or not.

Do you live on site? Do you have big glass frontage? Do have cctv cameras?

Has it really gone beyond the talking stage? What do other neighbours have to say about it?

No there isn't. Where did you get that information from?

Try doing a search on 'parking' and you will find a few recent threads with lots of good information on the legal status of parking outside your house.

It was probably under the advice of 'how not to fall out with your neighbours'. It's not a precident, it's just polite. Like there's no law that you must say 'please' or 'thank-you', but most of us do.

I'd agree.

When I lived in a shared house on Edmond Road, some git parked in front of our house. The one housemate with a car tried to park a few houses down and was bawled at from a window by the old woman who lived there. The woman was concerned that if her family happened to spring a suprise visit on hern then they might have to park elsewhere.

Unreasonable and with no foundation in the law (tug a forelock to the powers that be), but our housemate did as the woman demanded, none-the-less.

I was lucky enough to live on Edmund Rd in the days before car ownership was compulsory. Match days were a bit of a nightmare though.

We lived just beyond the garage...on match days the folks on the cul-de-sac across the road blocked their street off with wheelie-bins and manned their baracade like the Spartans at Thermopylae...community spirit ain't dead, it just don't look like jubilee parties in the street no more!

many thanks for your replies,im convinced its bully tactics,as i am a small female and he doesnt ask the men to move theirs,other neighbours have agreed with me and my car is being watched now,thanks for the baby monitor and camera advice too,i will let you all know what happens,we are looking into having parking restrictions outside the shop,but we are not keen because of the other neighbours,all this hassle for a mindless moron:)
