Hello,
I am a Polsih citizen and I rented an apartment with few people.I am signed /in the contract/ as "witness" and one of us as a tenant.
Being a witness-am I responsible for any damage done by the others in the property? Am I responsible in case the others do not pay week rentals?
Please, any of You let me know as soon as possible, because I want to avoid troubles while renting a house with the others-not responsible people.

S.O.S!!!

Hi Madlene, I would have thought that all you were witnessing was their signature on the contact, so wouldn't be liable for their damages, unless you signed as a guarantor.

Thank You very much for reply. Now it makes me feel calm.
If any of the others would be so kind to share such experiences with me - please don't hesitate as I have no idea about English law as far as lettings contracts are concerned.

I am sorry magdalena, but your responsibility may be included in the terms of the contract.
With the limited information that you have given, 2 situations come to mind.
One is that your friend has signed the lease as an individual tenant and will be solely responsible to the landlord or:

Second is that he/she has signed on behalf of all the named or "witnessing" tenants. In this case you become severally liable.

Only the specific wording of the contract will tell. you should make sure that you have a copy.

Hi Madlene,

Do you have a copy of the contract? or can you ask someone to make you a copy of it?

Where in Poland are you from then? My sister in law is from near Gdansk. I have been to Poland twice and i loved it there.

PM me if you can get a copy and i will be able to give you some free advice.
