Sheffield United are preparing to spring a massive surprise on the Premier League and West Ham after requesting that Carlos Tevez's owners MSI give evidence on their behalf.United chairman Kevin McCabe has asked Kia Joorabchian, Tevez's closest adviser, to help with their bitter legal fight. McCabe believes Joorabchian can help provide the evidence they hope will keep them in the Premier League.Sharp Blades: Tevez (left) failed to sparkle as West Ham lost 3-0 to Sheffield United - but his goals eventually kept the Hammers up as United were relegated.Joorabchian's legal advisers are discussing the possibility that he might appear in person — or at least give written evidence — at the Premier League's unprecedented arbitration panel, which sits on June 18 in London.His appearance could have a devastating impact on the defence put forward from Upton Park.
Sheffield United, who are refusing to accept relegation, are believed to be encouraged by his positive response.Joorabchian was unavailable for
comment yesterday, but has previously told Sportsmail: "West Ham have unilaterally terminated the (Tevez) agreement and I have left it in the hands of my lawyer, Graham Shear, to deal with the matter."
The panel is examining whether Premier League rules were followed and whether the independent commission acted correctly in deciding against a points deduction for West Ham over irregularities in the signings of Tevez and Javier Mascherano.
Well this is a turn up,it look's like Tevez's mate is a little peed off with West Ham.

How would it be a "massive surprise" if it is now common knowledge?

Contract law states that an agreement cannot be unilaterally terminated. In other words both parties have to agree.

If Joorabchian did not agree then the original agreement was never cancelled.

Contract law says no such thing - for example contracts can have clauses in them that terminate the contract should either party default on their obligations.

My point was relating to this contract.

Joorabchian has stated that WHU unilaterally terminated the agreement that is why he passed it to his lawyers.

WHU can not just tear the agreement up if it does not contain caveats to do so. In this case I find it hard to believe WHU would have had such caveats in place to terminate if the PL discvovered their sordid little deal and I'm damn sure Joorabchian would not.

There was obviously NO agreement between the parties to either tear up or amend the contract. The contract was therefore still in force and Tevez was fielded illegally in contravention of the FAPL rules, against Wigan and thereafter.

It rather like you taking out a loan, signing the agreement and then because it doesn't suit you tearing it up and telling the Creditor the agreements ended because your circumstances have changed.

So my pedantic chum if no such caveats existed in this particular contract then it can only be terminated bilaterally.

I think you`ll find there was an outcry long before the Wigan game. As soon as West Ham moved out of the bottom 3 the whole issue assumed a lot more relevance for the clubs at the bottom.Yes we were poor over the season as a whole,32 goals in 38 games tells its own story,but it would be nice to know that there was a level playing field for all the clubs concerned.If one club has benefited from preferential treatment then surely the issue needs further investigation at the very least.If nobody complains then nothing gets changed.Any club worth it`s salt would try and protect its own interests,particularly when large sums of money are concerned.Wednesday would be no different.Can you imagine Allen just rolling over and taking it?
I have no problem accepting that we were relegation material(everybody knew that at the start of the season anyway),as long as every club plays by the same rules.Personally,I don`t think we have a snowball in hell`s chance of being reinstated.Too many vested interests for that i`m afraid.It`s just happens to be our fate to be left holding the s*** end of the stick at the end of it all.My only real concern about the arbitration process is the effect it is having on our preparations for the coming season.At the moment we are in limbo,Robson can`t plan properly or recruit until we know for certain which division we are in.Whatever the outcome we need to accept it and move onwards and upwards.Hopefully Robson will be a breath of fresh air and give the club new impetus.A clean slate and all that,so to speak:) .

Take your point but that had nothing to do with utd going from a virtually being safe to getting relegated.I already said i think they should have been deducted points but they wernt.Clubs in that position have to battle whatever the circumstances and when push came to shove utd coudnt hack it.Warnock is probably the biggest culprit and not West Ham.:|

Yes I agree brooksy, we went down because we did not do enough all through the season, not the last match.Hulse getting injured did not help, I though if he had been in the Wigan game we would have won,but it's all over now as the man say's or at least until the 18th June.

I agree,West Ham`s form over the last few games was outstanding,and in no small part down to Tevez.There can be no disguising our own shortcomings, at the end of the day we were not good enough on the pitch.However, the principal of one team apparently recieving preferential treatment at the expense of other clubs needs addressing somehow.The decision not to deduct points on the basis of not being "fair" to West Ham`s fans is dubious to say the least.What about the fans of other cubs involved?IMHO the Premier League bottled the whole issue,hoping West Ham would be relegated anyway.By delaying the initial hearing until April it made it increasingly difficult for them to deduct points.All United are doing is trying to fight their corner and try to salvage something from a bad situation.Any club would do the same.It could quite easily have been one of the other clubs who ended up in our position,it just happens to be us.I think the whole episode just highlights the cronyism and inequality which runs throughout the Premier League.Like I say,I have no problem with us being relegated,as long as every team is playing to the same set of rules.Consistancy and equality are all that we ask.Everything else will take care of its self.

Football fixtures

Thursday is the first big date in the new football season with the announcement of the fixtures.
From the Premiership down to League Two, 92 clubs are waiting to discover who they will meet on the opening day of the 2007/08 season.

All four divisions kick off on the same day, with the Premiership and Football League starting on Saturday 11 August.

Sheffield United - relegated from the Premiership - are trying to win back their place in the top flight.

They believe West Ham should have been docked points instead of being fined £5.5m for signing third-party agreements in contravention of league rules when they signed Carlos Tevez and Javier Mascherano.

An arbitration panel on 18 June will hear the Blades' claim and plc chairman Kevin McCabe believes they could be reinstated.

However, on Thursday, Sheffield United's fixtures will be that of a Championship club.

Fairness OK West Ham should have been deducted points.
Fact on the whole throughout the season we played crap & deserved to be relegated.Actors then celebrities, MP's are useless will do what makes them popular give me strength. What as that Muppet labour MP Richard Caborn who is involved with sport done or said on our behalf what a waste of space, he as as much charisma as a dead pig, it would not have been so bad had he been a Wendie but alas, he is one of ours.

Wednesday fans were today urged to join Sheffield United's battle to overturn their Premiership relegation.
As a delegation from Bramall Lane prepares to take their protest to the Houses of Parliament, where nearly 50 MPs have signed an early-day motion calling for Bryan Robson's side to be reinstated in the Premier League, United have unveiled details of a city-centre rally designed to coincide with tomorrow's visit to Westminster.

And Sheffield United fans leader Richard Batho wants to see Owls supporters join them in a rare show of unity.

Tomorrow's event, which is scheduled to start around 1pm at Barkers Pool, will enable those fans not travelling to London to protest loudly but peacefully against the FAPL's failure to deduct West Ham points for a serious breach of transfer regulations during the 'Carlos Tevez Affair' - a decision which United argue cost them their top-flight place.

An independent arbitration panel is scheduled to begin investigating the matter next week and ,as the media spotlight once again prepares to focus on a matter which threatens to plunge English football into chaos, United know that a big turnout would place even more pressure on the FAPL.

Batho, spokesman for influential fans group BIFA, says the issue bridges the region's partisan divides.

"Hopefully fans from both clubs - United and Wednesday - will turn out because this has the power to affect everyone," he said. "The more people who turn out, the better. We need to get across the message that football fans in general aren't prepared to stand by when something like this happens.

"United supporters must attend in numbers but it would be great to think that everyone from the region, whether they follow us, Wednesday, Roth-erham, Barnsley, Doncaster or Chesterfield, will also lend us their backing. It really is that important."

Earlier this month The Star delivered a dossier of complaints from readers to the FAPL. Despite their refusal to accept the material in person, a Blades supporter has received confirmation that FAPL chief executive Richard Scudamore has taken possession of it.

It is not just about being a Blade or Owl it is for fairness in football & I believe that all Yorkshire fans should fight the Southern PL cheats,they don't give a toss about us up North they never have & if it had been any team in Yorkshire I would still back them.Scudamore cannot get away with favouritsm to West Ham & it's supporters.What will happen if a player slips through the PL net again what will they do fine them or deduct points they have dropped one big Bollock.UP THE BLADES

Well said freyasdad that's the point I made in a post further up from your's.All football fans should support football being fair for every supporter not just for the elite few,not meaning that West Ham are elite because they aren't.Unless Fairness is restored football in the PL will alway's be remembered for the Tevez & Mascarino story.

Even though i can't stand wednesday personally if they have had to go through the miscarriage of justice that we have had to then i would support there cause all the way because like many others have said it's about fairness in football not about us as a club.

Middlesbrough's chairman Steve Gibson yesterday offered Sheffield United his vocal support in their quest for "fairness" over the Carlos Tevez-West Ham issue but he has refused to become active on behalf of the Bramall Lane club and said he is not persuaded by the idea of the Premiership being expanded to 21 clubs next season.
Gibson, who hopes Middlesbrough make "one or two spectacular" signings this summer, said: "I don't know all the facts about Tevez but if I were Sheffield United I'd take it as far as I possibly could because you are duty bound to your manager, players and your fans to do that. We get on very well with Sheffield United and I wish them well."
With the Blades due to send representatives to Parliament today in their "Campaign for Fairness" over Tevez, Gibson's backing is timely but he is reluctant to become embroiled in an inter-club argument. His opinion has weight given Boro's three-point deduction 10 years ago that led to the club's relegation from the Premiership.
"We don't think it's appropriate to support one club against another club," Gibson said. "I think it's not right this club should act as judge and jury, I think that's what the Premier League and the FA are for. The Premiership has been 20 clubs for a long time, it's obviously the best formula. To make it 21 is too easy a way out. I think it's for the 20 clubs to comment on."
The Yorkshire club will discover their fate when the arbitration committee meets on Monday and Tuesday. Fulham's owner Mohamed Al Fayed has also given United strong backing.
"What happened to us 10 years ago is buried," Gibson added, "it still hurts and I'm still a bit bitter about it.

the football world in general (and that includes wednesdayites) outside Sheffield United dont support the blades cause because its complete rubbish

united were relegated because they werent good enough to stay up
simple as

yes west ham have broke some administrive rules but tevez was always registered to play for west ham

they were punished (heavily) for what they did

and united were punished for being cráp over the course of a season basicly (IE the team with the lowest points/goals scored is relegated)

the fact of the matter is...they are asking for "justice" but justice has already been served.

50 mps have signed this motion (600+ havent) I think that says it all really

But Tevez was registered as a west ham player, the issue was regarding third party ownership which under premiership rules is not allowed, docking points was never going to be an issue just a fine in which West Ham were dealt with far too severley.

No one heard any blades fans whining about West Ham when you were 10 points clear and playing weakened sides against Manchester United so your players were better refreshed for the Charlton game.

See you next season for 2 interesting derbies

i have been to watch blades twice this season, as all my family are pigs who have season tickets and had a spare. (i hate to admit this, but i was curious to see what all the fuss was about) as i thought, it was crap! the ground has lost any traditional appeal to it, and as for a hotel? why would anyone want to stay in ethnic studentville highfield?
I agree, parts of hillsborough need a lick of paint but deep down you know its a special ground. The entrance to the south stand is unique, our kop is one of the biggest in the country and always has been. Our north stand was the first of its kind. Yes we are in debt up to our eyeballs, i admit, you are a much better run club than us in recent times, but things can change as all owls fans know.

This is why United, Charlton, Fulham, Middlesboro, Wigan, Watford, Brighton etc have complained so late! Because the premier league decided to punish west ham so bloody late !!!!! I agree West Ham should have been hammered for the offence.

But here's why I don't think anything will be done for the Blades. The rules state that the maximum penalty for the offence is a points deduction.

Not a 3 point deduction, just a points deduction.

Now Sheff Utd can't go to the Premier League and demand they dock West Ham just enough points to save them from relegation, as that's not right either.

Breaks my heart to see the Blades going down instead of the cockneys, but I can't seen any other outcome unfortunately.

As for highbury (and yes it does have two H's in it) was a cracking ground, it stood for class, glamour and tradition. Theyd be just about selling out every match, instead they have massive gaps at matches, and the atmosphere suffers. It's also built on old wasteground, the other side of town from the old site at moss-side.

I do think highbury is better as a matter of fact and ive been to both. Its traditional and is what football should be about.I think big money and big new grounds have spoilt football. Both liverpool clubs moving, everton to kirkby which isnt even in liverpool! just for the sake of 'progress'.

yes but its 1 miles difference and they have always played there, or at least for a very long time. Kirkby is miles out, and part of knowsley. Its a sad state of affairs.

Should not have been hoping that an administrative error from another club would be the reason for staying up.

I really thought Utd would win or draw their final match - but their playing skills let them down - again.

I went past this at about five to one in Barker's Pool and there was a raggle-taggle of about 150 United fans at most - the Calendar OB unit was there as well so it'll be on there tonight (unless somebody drops a hankie in Leeds :hihi: ). There were nearly as many police, stewards etc, all wearing day-glo jackets with 'Major Event' on them. It didn't look much like a major event to me - it looked more like most United fans had given up the ghost.

As someone with no axe to grind either way, I think United are deluding themselves if they think they're suddenly going to be reinstated to the Premier League and West Ham relegated. It just ain't going to happen. And as many others have pointed out, if United had won a couple more games when they were 10 points above the drop zone, or even if they'd got a point against Wigan (who, let's face it, were not the most difficult teams to draw against this season), then they wouldn't be in the position they're in.

United are banging on about Tevez keeping West Ham up, but Tevez played for West Ham all season and for about 80% of it they were absolutely dire. If anybody's got to be given any credit it's Curbishley for getting them back to being motivated for the other 20%. One man doesn't make a team, however good a player he is. Somehow though I think if the boot had been on the other foot, and Tevez had signed for the Blades and they had stayed up, we'd be hearing a very different story from United fans now. As it is I think it's just making them look like poor losers.

There are plenty who are the same for United, and I'm sure the hatred and bitter rivalry must fill some kind of void in some peoples lives, but some of us just want to see what is good for the game, and for the city. I, for one, am a United fan who wants to see Wednesday do well, and I'm encouraged by the progress they are making in the face of adversity... It can only be good for the city to have two teams who are looking like potential promotion/play-off contenders.

If you have to rely on other teams having points deducted to secure your place in the Premiership you really don't deserve to be there anyway.

United and their supporters should be spending the summer regrouping and concentrating on why they didn't play well enough to be in the clear of the drop zone in the first place...or why they didn't play well enough to beat Wigan in the last match.

Easy The premier league made the hearing for the disciplinary action against west ham sumthin around 6 - 7 months after the players registered with West Ham. This is why United, Charlton, Fulham, Middlesboro, Wigan, Watford, Brighton etc have complained so late! Because the premier league decided to punish west ham so bloody late !!!!! That explain it for you?

is this around the time that you where 10 points clear of the relegation zone and you thought you where safe then? so didnt really bother saying owt? but as in football nothing is certain and west ham won all those games yet united couldnt pick any points up away from home?

Yeah, and we (ie Leeds) will be back there too come the season after next.

Either that, or playing local derbies against a promoted Farsley Celtic in the 4th Division. Now that would be a match I never thought could happen!
