I'm thinking of putting a flat for sale before 1st june to avoid paying for a Hip.
How do you prove you have put it up for sale before June if selling privately? Do you have to advertise it in a paper? Anyone got info on this?

I would imagine that you'd want some sort of proof that you marketed it before 1st June (e.g. a receipt for an ad in the paper etc...). Having said that, how would anyone prove that you didn't market is before 1st June?
Dont really matter now they have put off the launch until August and then it only matters if you have 4 or more bedrooms.

The new rules include the HIP's only applying if the dwelling has 4 or more bedrooms so the majority of homes wont be included. Try the BBC news website for more details.

Ministers have admitted they do not have a legal definition of what constitutes a four-bedroom house or larger property.
Tory MPs warned of further chaos if estate agents and house sellers attempted to avoid the £300-£600 cost of a HIP by describing a fourth bedroom as a study or boxroom.
So from August 1st 2007, with no legal definition of what constitutes a 4 bedroom or larger property, why not describe your home as having several rooms and a small computer room, or just a large 3 bedroom home.

Or a 3/4 bedroom home - currently the way of describing a property with 3 bedrooms and a small cardboard box in the attic.

The definition of selling privately is
Private sales where the property is not offered on the open market (eg. to a family member, neighbour, or friend) you do not need HIP.
Are there any exclusions to the sellers pack?
The following will be exempt from the Home Information Pack regulations:
Properties smaller than 4 bedrooms
Properties in Scotland and Northern Ireland
Private sales where the property is not offered on the open market (eg. to a family member, neighbour, or friend)
Non-residential property (i.e. shops or mixed commercial)
Properties sold with sitting tenants and not available for owner occupation
‘Right to Buy’ sales by Local Authorities or other social landlords
Homes held on a lease of less than 21 years
New homes - no survey required if sold with an NHBC, Zurich, or similar warranty.

princess275 04-06-2007, 11:28 i just read somewhere that apparently, if you dont prepare HIPS and put your hosue on sale without them, the fine is 200 pounds. I am begining to hear people suggest that maybe thats the cheaper option if the fine really is 200 pounds.
joeyannie 04-06-2007, 11:43 Isn't it a £200 daily fine? so unless you sold in a day it would cost more than the HIPS reports anyway.
princess275 04-06-2007, 11:58 it seems you could be right. i literally read the view I mentioned above in a number of places. After your comment, I have done a quick research and it seems people writing about it are not clarifying that its per day (or they don't know themself). good you spotted it!
No need to pay the ridiculous prices estate agents are banding around. The pack was designed to be completed by the individual however the big corps who make the monies from our property sales are indeed skimming yet more from the unsuspecting client.

For people thinking of selling please look at the dates on these posts - they refer to last year! There are changes to HIPs in June but not the ones discussed here.
