hi people,
I live in an apartment which I share with one other person. We moved in on the 28th July 2004 and signed a 12 month contract (shorthold tennancy agreement).
I am now having to move away from Sheffield due to work and will have to move out of the apartment. My problem is that I can't afford to carry on paying rent here in Sheffield and in the place I am moving to. My housemate won't have a stranger move in and neither of us know anyone that wants to move in straight away. My housemate wants a friend of hers to move in, but not until May, which would mean that she expects me to pay full rent until then, which I can't afford to do.
The landlord has said that its ok to move someone else in as long as I give her their details so that she can do a credit check on them.
I am moving on December 18th, so I need to get this sorted out quick.
Does anyone have any ideas or advice on this?

If your housemate won't countenance a stranger moving in then I suggest she pay the whole rent for this privilege.

She won't do that, my name is still on the contract, therefore I am responsible for paying. The only way I can stop paying is move someone else into my room and get the landlord to put their name on the contract instead of mine.

Its got nothing to do with your housemate. Tell the landlord and just arrange for someone else to move in anyway. Housemate can do sod all about it apart from move out.

I absolutely agree. The contract is between you and the landlord so all you need to do is find some-one agreeable to your landlord (ie. good references) and get him to change the contract. It might be easier if your housemate moves out anyway as it sounds like there could be a problem there and then 2 new people can sign.

So you're prepared to find somebody to pay the rent. Great! You've covered your side of the bargain.

If your hosemate wants to veto them then the housemate should find the new resident. Simple really. That's what we did when somebody moved out of our digs. It's the only way to guarantee the housemate will approve of them.

Hiya! As far as I know you have the right to move somebody else into the flat to fill your place. Despite the agreement states your name, Landlords usually allow tenants -especially good ones- to find someone else to carry on the contract. Shame your flatmate isn't that supportive, but consider she will see her privace invaded just like that. It might help if you talk to her. -:heyhey: buy her some chocolates -

I have already tried to talk to her, but she can be a bit difficult. I could just find someone who is willing to move in and arrange it all without her knowing, but will the landlord require my current housemate to sign a new contract with the new person that moves in or will the landlord just change names on the existing contract?
If I did decide to just move somone in without her knowing, she would definately kick up a fuss, as she intends on moving in her friend in may, but I can not wait that long. As far as my housemate is concerned I have to pay my half of the rent until may because my name is on the contract. If I just moved out and stopped paying rent, I am sure that the landlord would issue a court order against me, as my name is on the contract I am still responsible for paying the rent whether I am living in the property or not

if you're moving out, you don't have to face your housemate do you? put your foot down and find your own replacement, and your housemate can like it or lump it!

For gods sake stand up for yourself and stop being a wet blanket. Its the landlord that decides who moves in, not your housemate..she doesn't have a leg to stand on. Place the responsibility on the landlord and get them to put her straight. Let her kick up a fuss but its got **** all to do with the whining bint.
If she doesn't like it then she can do one.
