View Full Version : Vodafone Warranty issue! What are my rights?
Hi
I bought a pay as you go phone from Vodafone in August last year, so around 7 -8 months ago.
The handset has become faulty. Each time i press * & left key to unlock keypad, it reboots phone & sometimes the phone totaly becomes dormant unless i take out the battery & replace.
I assume that the contract is with the shop!
I called Vodafone 2 times. 1 person said the faulty handset issue is between me & Sagem & another said that the contract gives me 12 months with the shop.
I need the phone every day. If they send the phone off for repairs do i get a courtesy phone or do they just replace it!
What are my rights!!? I have all the paperwork & receipts!
Surely they don't leave you phoneless.
Any advice appreciated
Rom
Does anyone know my consumer rights in this situation??
Help

If it was a contract phone youd probably get a loan phone for the duration of the repair. As its PAYG, you probably wont. Go back to the shop you bought it from, tell them what the problem is, and see what they say. Theres not a lot more you can do, TBH.
Even with a contract I doubt you'd get a loan phone unless you took out their insurance cover. I would have thought that the shop you bought it from has to honour the warranty, but their solution might just be to send it off for repair, however long that takes. If it's that vital, can't you just buy a replacement cheapo PAYG phone?

I found this (http://www.consumerdirect.gov.uk/before_you_buy/thinking_about/mobile-phones/#named3) information on their website. I hope it's of some use to you.
Good luck.

It is.
You have the same rights as any other sale. You will have a one year warranty with the shop as long as you have the receipt.
A loan phone is a favour on PAYG and it's down to the shop if they wish to do it.
I know they do so for contract phones as I have had problems twice in the past with newish phones but can't tell you about PAYG.
Smile, be nice and hope they are in a good mood. It's more effective than shouting and quoting rights.
fnkysknky 01-04-2007, 18:48 Normally they ask for a deposit and then give you a loan phone.
I got it from Fargate Vodafone. I hope they do! I need it for work etc. I got all appointments in callendar & pics & texts!!
Are they stored on SIM card like contact numbers?.
I remember taking it back because of a fault after 3 days & they straight swapped it!

No. The only thing stored on your sim are your contacts. Anything else will need to be backed up to a PC using bluetooth, IR, or a data cable
I posted on a consumer forum & they said the phone shop can do this & put it back on the phone when fixed!.
I haven't the option of what you say & i'm taking phone back tomorrow!

fnkysknky 02-04-2007, 10:41 It's not their responsibilty to back your data up. When I've taken a phone back in the past (and when friends have) I've been told I will very likely lose any data on it before they accepted it. Although it would be possible for them to back it up it's not something they'd usually offer to do as they wouldn't want to be held responsible if there's then a problem restoring it.
I think the standard phrase in their warranty will be something like, "if the handset develops a fault within 12 months, we will repair or replace (at our option)". It'll also state that it mustn't have been misused. They'll very unlikely be something stating that they'll provide a loan phone - that's what their insurance is for.
I think that standard practice at the repair centres will be to return a unit with it having been factory reset - all your data gone. Depending on the model, you should be able to transfer the data to another medium. Speak to the shop before it gets sent off though!
I took phone back. They have sent it off for repair & it will take 9 days.
They said i could buy a cheap phone for 30 quid & also strangely leave a deposit of 100 quid! Why the deposit if i buy one, which would be mine, i don't know.
When it's factory reset, i assume i'll get it back as it was when i bought it, like with the preset default wallpapers & tones that came with it?
I have had bluetooth prob with this pc or i'd have done it that way, but most things i texted to a friend & they will save them on their phone & text them back to me when mine is back.
