It boils down to whether he's 'ordinarily resident', not to mention his financial status, etc. There would only be an effect on your benefit if a fraud case were raised in any case, or if you declared a change in circumstances. Sorry that's vague, but that's the rule. baileys_mum 15-03-2007, 19:32 I don't think they are allowed to stay over at all now happyhippy 15-03-2007, 19:38 Yes they can. It's just that it can make a difference to the level of benefit if both people are claiming, and living together. Actually, there are a couple of things I should have asked. Firstly, is it Incapacity Benefit, or Income Support with a disability premium that you claim, shefflass5? Secondly, is your new boyfriend working, or not? laughalot01 15-03-2007, 20:52 im almost certain they can stay up to 3 nites a wk Douglas J 15-03-2007, 21:21 No - Happy hippy's the only one who's correct on this page. Can I suggest an advice centre for some accurate advice because it's a famoulsy tricky area. the "3 nights a week" "rule" is one of those myths that advice workers hear all the time! mojo1 15-03-2007, 21:27 As long as you can prove you live seperate lives then you will be ok, don't worry about it. I'm on incapacity and disability and my boyfriend works and owns his own home and it doesn't cause any problems for me as he doesn't contribute financially to my household. Some weeks he stays over for 1 or 2 nights and others its 3 or 4. artisan 15-03-2007, 21:38 Be careful what you say, computers have ears, to paraphrase a WW2 saying.:( mojo1 15-03-2007, 21:41 I know somebody in benefit fraud so I know my rights :) happyhippy 16-03-2007, 02:07 No - Happy hippy's the only one who's correct on this page. To be fair, no advice is neccessary unless either of the questions I asked have a bearing on a decision. This is a very easy one to solve. |
