I want to register a domain name and have the same name as the trademark.

I will also need it copyrighting, any advice on my best course of action?

Try this website (http://www.patent.gov.uk/tm/) for info about trademarks. Why do you want to trademark it? It will cost you lots of money and AFAIK they have pretty strict rules on what can and can't be trademarks.

You can't copyright a domain name - but you can copyright the content. You can only copyright something that you've created (i.e. songs, lyrics, text, paintings, photos, content etc...). As soon as you "create" something, you automatically own the copyright. (The only time you have to pay something is if things get legal...)

Try reading this website (http://www.patent.gov.uk/copy/) for more info on copyrights.

The http://www.patent.gov.uk website is a good resource for all things related to this kind of thing...

Basically I'm setting up a business and I want to make sure that the name I give it, isn't infringing on someone elses copyright or TM.

The website will be a business and I'm trying to make sure I've got all basis covered. Once it's up n running, I dont want to scab copying the idea!

Whats a good site to register a domain name? Do I need to buy web space from them also? How does it all work?

A .co.uk domain name costs just £10 for two years. .com costs more.

The best host I have found so far and is the one I want to move to is Green Man Hosting.

Their top hosting package is as follows:
300mg of space and 6gig of bandwidth £49.99pa or £5.99pm

They have a link on their site that show sdomains for about 9p

Get them from www.UKReg.com - a ".co.uk" is £2.95 a year, ".com" is £9 a year... bit cheaper than Easily.co.uk and much better support (I've bought from both).

You can get webspace when you signup with UKReg or get it from their parent company: www.FastHosts.co.uk. They're really reasonably priced and cater for any size website!

FastHosts start from as little as £1.99 a month (100MB webspace, 15 mailboxes and unlimited email forwarding). I use the Home Pro account that's £8.99 a month or £69.99 a year (you save if you pay in a lump sum) 1GB webspace, 300 mailboxes and unlimited email forwarding... but they go much higher than that!!! It depends what scripting language and databases (if any) you're going to use...

Is there a problem with who you purchase your domain name from! Are they all the same? Do you never need to switch?
Do you have first dibs on renewing you domain name when it's renewal time?
Can you get webspace from anyone even thought you have purchased the domain through www.blah-whoever.com?
What about email addresses with your domain name at the end! Can you have as manay as you like for free... or are they extra? Who supplies them etc?

No problems - but some own it and merely "lease" it to you. When you buy from Easily and UKReg you definitely own it and can transfer whenever you like.

It's upto you - some places are cheaper (I transferred mine from Easily to UKReg) and some have better support / services.

In most cases, yes - but I've found it's better to get both from the same place.

Depends on your host. Sometimes you get free forwarding, which means you get any email sent to your domain forwarded to an email address of your choice (your Hotmail account, for example). Others give you POP3 mailboxes and / or webmail...

With the pop 3 account if I had email addresses setup, do I just use it through outlook and set it to go to pop3.mydomain.co.uk
or pop3.ukreg.co.uk?

Do I need have webhosting in order to get mailboxes or do I get mail forwarding with the domain name?

Again, it depends on your host - but, yes, I just use "pop.mydomain.com" to collect my emails using Outlook Express.

You normally have to buy hosting to get POP3 mailboxes - email forwarding normally comes free with a domain name.

And in answer to your previous question about scripting ("Eh?") - if you don't know what I'm talking about, then ignore it... you can probably get away with a basic hosting package (good news for you because prices go up if you need some types of scripting support)...

Generally DB I would go with recommendations mate.

Easily are a very popular registrant of domains, though I personally hate their site.

I'll probably go with UKReg to be honest, although my work LAN is very slow and not loading the site very well!

The name I want I know is available cos I searched under the Easily site for it!

Just want to make sure I get things rights!

Trade marks - may be less of a priority than establishing a business under a trading name and getting the corresponding domain name and making sure you aren't infringing a pre-existing TM or trading name.

I've recently registered a couple of domains with Black Cat Networks (http://www.blackcatnetworks.co.uk). Not the cheapest, but they do domain registration, forwarding of unlimited email addresses @yourdomain, and website redirects, as well as a variety of hosting packages starting at £25/year. Also good customer service - it's a fairly small, two man operation, so you get a personal reply to emails within half an hour or so.

Anyone know if there is a website I can check with business names and TM's to make sure I wont be infringing with the name I use?

I already know that the name I want is gone as a .com address!

I do... sure, they have their problems - but doesn't everyone? It's not normally anything serious anyway.

(Even paying £1.99 a month, you'll get 24/7 telephone support - and not on a "£1/min premium number" either!)

OK Tony, I've got my new domain name through UKReg and I have setup some free forwarding email addresses.
Just one problem. When I try to reply, it reply's from my ACTUAL email address and not my new domain address... how do I config it? Or can't I config it till I pay for some web space from UKReg?

You should be able to edit your originating email address in your email client - in Outlook Express you can find it in {options}-{accounts} #select account# -{properties} and click on the general tab. You can then change your email and reply-to addresses.

DaBouncer, Phanerothyme is spot on. However, make sure you do a couple of tests to and from your new email address to some other account (Hotmail, AOL or whatever you normally use) as some ISPs (I think btopenworld is one) won't let you send emails from any other domain except theirs! (There are ways round this though. For example, I think you can call BT and get them to add your domain as an "allowed" domain on their SMTP servers.)
