My freind had to go to court today over something that happened to her little girl and her friend, now i dont want to go into much detail of the case but 10 minutes into the hearing at Sheffields Crown court the Judge decided to throw the case out because it had come to light that the Boy aged 15 who was the defendant had suddenly developed mental health problems apparantly now he has the mental age of a 10 year old and the judge didnt want to put him through a trial !!!!!!!! but people who know the case and the family know its a blatent lie.The girls have been through so much not only through their ordeal but the police videos and endless interviews, My freind wasnt even told of this new evidence until today.
The CPS say that there is nothing more can be done, does anyone out there know how they can take this case further.

You can't. Sad but true.

You couldn't even bring a private prosecution because that, too, would be thrown out of court if he's still claiming mental health problems.

Depends how well he's been assessed I guess... not sure you'd be able to get a second medical opinion...

Ouch. That's really nsaty. You could try asking for the evidencde presumably from some "expert" psychiaTrist and see what can do to have it discreditted. There could also be procedureal issues for not having disclosed evidence but if ithis assessment's only just been done you'd probably be on tgo a sticky wicket. What does your solicitor sauy?

More or less the same thing happened in the case of the daughter of a friend of mine who was raped a few years ago. The piece of scum who did it got off because the defence claimed that he was an imbecile at the time that it occured and the judge accepted it as a fact. It seems to me that the only imbecile involved in that case was the judge.
