The woman next door to me has gathered up all the leaves on her garden and thrown them over the hedge onto my garden. I know she has done this because somebody saw her do it and told me.

I went round and asked her why she had thrown the leaves onto my garden, she said "they are not my leaves they come from your trees).

Does anyone know what the law has to say about this, are they my leaves?

She has two trees on her land that are the same type as one of my trees so how does she know whos leaves they are?:loopy:

My advice is to go round to her garden and dig up her trees and throw them over the fence into your garden as well.

What sort of relationship do you want to have here?

If she's that pathetic she's probably quite happy to make a nuisance of herself in other ways. I'd just bag the leaves up and the next time she wants anything from you just refuse.

Getting the law involved in a spat like this is going to benefit no-one except the lawyers.

you should buy a goat then ask if you can have more leaves to feed it on!
if you cant buy one i think they have them in Graves Park (def got sheep if no goat available), you could always "borrow" one for a couple of days.

I think I will, the next time she cuts her conifer hedge i'll throw all the cliping that fall on my side back. :D

Better still I think I'll put them in a bag and leave them on her door step with a label "your leaves I presume":hihi: :hihi:

Personally id pile them up and let her see me messing with them and adding tea bags and stuff. Let her think she was doing you a favour by throwing the leaves over. If shes got a grudge against you thats a good way to really wind her up, plus she might even keep the leaves for spite!

Get a dog and start flinging all it's poo into her garden.
Next summer, when the dandelions are seeding go and collect the seed heads and empty them onto her lawn.

I'm getting a lot of leaves blowing onto my property from both my neighbours' trees and some from the highway trees. Can I charge them for cleaning up and disposing of their leaves?

This is probably one of the most contentious issues to come across which, as far as I'm aware, has not been fully answered by common or statute law.

It seems, from my research, that it is generally viewed to be unreasonable to burden a tree owner with being responsible for every leaf shed from a tree in his ownership, particularly as it is accepted that leaves will carry long distances in the wind and also tend to gather in places that 'trap' the leaves. Plus, how could you definitively identify the leaves as coming from that particular tree and not another of the same species reasonably close also? It is felt that the courts would be relatively uninterested in granting remedy for such minor complaints, viewing leaf fall and the sweeping of leaves as just a normal part of life.

Leaves or other natural tree debris (nuts, berries, blossom etc) that somehow cause actual damage or injury, however, fall into that state of affairs that leaves (no pun intended) the tree owner open to be sued for damages and/or compensation.

Honey dew is the excess sugar fluid exuded by aphids as part of their feeding. It falls in fine droplets from infested trees, particularly lime trees, where a heavy infestation can result in objects below the tree being coated in a fine sticky residue. If left this sugar coating will encourage the growth of an unsightly black mould. As far as I can determine in my research, the sugar solution is not damaging and can be removed by ordinary warm water and detergent. Some people have claimed that it damages car paintwork but again I have found no scientific proof that this is the case.

My property is covered in leaves from a tree that doesn't belong to me. What can I do?

The legal view is that once a leaf falls from a tree it belongs to no one as you cannot determine its flight path, due mainly to the vagaries of the wind and weather. The law also has determined that it is not unreasonable to expect you to clear up leaves, if you live in an area where there are trees.
Therefore, the answer is that you can do nothing except clear up the leaves or move to an area where there are no trees, which may be hard to find.

:hihi: Without wishing to out-do Jabber and his composing idea.....

I'd set up camp on her front lawn and carefully sort the heap of leaves into two piles - her leaves and your leaves :D

Additional equipment for this process could include a magnifying glass or microscope, a swab and some form of liquid, and/or calipers and steel rule :D



If you're feeling really irritating, this can be carried out on her doorstep, and each individual leaf deemed to be hers can be posted through her letterbox :P

Wanna come to my garden and collect some snails?

I may have some thistle seeds you may also be interested in ;)

get the church to clean the leaves away, as god created everything,they are his leaves,the church work for him,give them a ring and tell them if they dont come and move their leaves your going to write a strongly worded letter to their boss......:hihi: :hihi:

Well ............ not one to be a bitch ......... but if she did that to me, I would kindly take them back, I would thank her, and make her a lovely cup of tea........


then I would go back to my garden and put the leaves right next to the fence, and BURN THEM, hoping the wind will blow the smoke into her side of the house, and hopefully burn down the fence.....

I would go back to her house and say "have you got anymore leaves".......... problem solved.

But dont try this at home please. :thumbsup:

If the tree overhangs her garden then iv a feeling its her tree too. At least for that percentage of it and therefore is her responsibility. Much like the side of the hedge that is on your garden is yours whether you want it or not.

I'd gather them up and throw them back over. But thats me :P

Actually, I do hate maintaining fallen leaves and things. I didn't know all my neighbours immaculately sweep theirs up. No wonder their garden looks immaculate !

This reminds me I should throw my neighbour's cat poo over in her garden too, and then the dog poo into the other side. Cheeky sods.

To lessen dispute, maybe either put a type of nets on the trees to stop them from going into her side, and then at least you can prove they were not your leaves. You can then also sweep some of your leaves and chuck it over to hers ! Yes, they're HERS now. :hihi:
