during the fire at fletchers, alot of traffic was diverted , and i got to a road, where traffic was moving slowly,
the opposite direction was at a standstill, what i saw was very funny, a black 4x4 was stationary cos of the traffic, when suddenly the car behind (must have dozed off) hit it from behind, the driver (the one who hit the 4x4 came out slammed the door real hard, and demanded for insurance from the other driver

what happened next i don't know

huh?????

so if a car hit me from behind cos i was waiting at a traffic jam , it is my fault?? duh:confused: :loopy:

in most collisions of that ilk, it's generally considered that the vehicle that was behind is at fault, for not giving themselves enough braking time/ space.

PT is correct. 99% of -rear end shunts of the fault of the person behind and are therefore assumed to be as such in the absence of fault admission. My last 3 accidents have all been down to someone running into the back of me and all damage has been fully recoverable fom the 3rd party.
The only exceptions and mitigations I know of are
a) sheet black ice - patches of ice and snow mean simply to allow more room.
b) no brake lights on the vehicle in front (mitigation); you should still have left enough room to stop.
c) deliberate dangerous driving - cutting in front of someone and then slamming on brakes.

how does ice stop it being your fault? It doesn't make it the fault of the driver in front, so who takes the blame?
